These Terms and Conditions (“Terms”) govern the use of Mulberry Lane Play Café facilities and services by parents, guardians, and their children (“Participants”). By purchasing a pass or membership or by entering the premises, Participants agree to these Terms. Please review them carefully.

 

1. Service Overview and Parental Responsibility

• Nature of Services: Mulberry Lane Play Café provides supervised play services, access to structured classes, interactive activities, and member-only events. Mulberry Lane is not a drop-off service; parents or guardians must remain on-site during their child’s supervised play.

 

• Excluded Care Services: Supervision does not include diaper changing, feeding, administering medications, or other personal care tasks. These responsibilities remain with the parent or guardian, and parents will be notified if their child needs such attention.

 

• Parental Presence Requirement: Parents or guardians are required to stay on the premises while children are in supervised play. Acceptable areas include the café, co-work space, and partner restaurants (Evening Star Café, Front Porch, Hi-Fi Tex-Mex BBQ). Parents must be available to respond to their child’s needs immediately.

 

2. Membership and Pass Terms

 

• Auto-Renewal Policy: Memberships are subject to automatic renewal as outlined in the membership agreement. Payment will be billed to the card on file at each renewal interval. Participants are responsible for ensuring payment information is up to date.

• Cancellation Policy: Participants may cancel memberships by providing written notice at least 15  before the next billing cycle. Cancellations after this period may result in charges for the upcoming cycle.

• Refund Policy: Refunds are not provided for cancellations after the start of the billing cycle. Early termination fees may apply for cancellations prior to the end of a contract term if applicable.

 

3. Assumption of Risk and Liability Waiver

• Waiver Requirement: All Participants must sign the liability waiver before entering Mulberry Lane Play Café. This waiver releases Mulberry Lane from liability for injuries or accidents that may occur during supervised play.

• Assumption of Risk: Participants acknowledge that supervised play involves inherent risks. By engaging in these activities, parents and guardians assume all risks associated with their child’s participation.

• Release of Liability: Mulberry Lane Play Café and its affiliates, employees, and agents are not liable for any injuries or damages arising from supervised play, use of the premises, or participation in activities.

 

4. Behavioral Standards and Facility Rules

• Conduct Requirements: All members and guests must adhere to the posted facility rules. Any violations, including disrespectful behavior or damaging property, may result in the termination of membership without refund. 

• Parental Conduct: Parents and guardians are responsible for their children’s behavior and must cooperate with staff if behavior management is required.

• Facility Departure Prohibition: Parents and guardians may not leave the premises while their child is under supervised care. Leaving the facility without immediate availability may lead to suspension or termination of membership privileges.

 

5. Intellectual Property and Media Release

• By entering Mulberry Lane Play Café, Participants consent to the use of internal surveillance systems on the premises for safety and monitoring purposes. Mulberry Lane reserves the right to capture photographs or video content within the facility. Participants acknowledge and agree that Mulberry Lane may use this content, including images or videos of minors in supervised play, for promotional, marketing, or security purposes.

6. Billing and Payment Terms

• Automatic Payments: By purchasing a membership, Participants authorize Mulberry Lane to charge the payment method on file for recurring fees according to the membership agreement.

• Failed Payment Consequences: If a payment is declined, membership privileges will be suspended until payment is resolved. A late fee may apply.

• Fee Adjustments: Mulberry Lane reserves the right to adjust membership fees. Participants will receive 30 days advance notice of any fee changes before the next billing cycle.

 

7. Cancellation and Refunds

• Cancellation Notice Requirement: Participants must notify Mulberry Lane in writing to membership@mulberrylaneva.com at least 15 in advance to cancel memberships. This ensures cancellation before the next billing cycle.

• Refund Limitations: No refunds will be provided for cancellations within the active billing period. Memberships may be eligible for pro-rated refunds under specific, documented conditions, such as facility closure.

 

8. Health and Safety Policies

• Sanitation and Cleanliness: Mulberry Lane follows strict sanitation protocols. Parents are encouraged to notify staff of any allergies or medical conditions that require accommodation.

• Sick Policy: Children who display symptoms of illness are not permitted on the premises. Mulberry Lane reserves the right to refuse entry to anyone who poses a health risk to others.

 

9. Late Pick-up Fee

Parents or guardians are responsible for picking up their child promptly at the end of the supervised play session. A late fee will be applied for any delays in pick-up:

• $10 for the first 15 minutes past the scheduled pick-up time.

• $15 for every additional 15 minutes thereafter.
 

10. Termination and Modification of Terms

• Right to Terminate: Mulberry Lane reserves the right to terminate memberships for any violation of these Terms. Terminated memberships are not eligible for refund.

• Amendments to Terms: Mulberry Lane may amend these Terms at any time. Changes will be posted on our website, and continued use of services constitutes acceptance of the revised Terms.
 

11. Acknowledgment and Agreement

• By purchasing a membership or pass, signing the liability waiver, or using Mulberry Lane facilities, Participants agree to these Terms and Conditions. Participants affirm that they have read, understood, and agree to all policies outlined herein.
